The short version
- The OpenCPR code is free and open source. You can use, adapt and deploy it under its open-source license.
- OpenCPR is a CPR practice tool. It is not a medical device, it does not certify anyone, and it does not replace an accredited CPR course.
- You supply and are responsible for the hardware, the installation and how the kiosk is run at your site.
- The code, guide and support are provided as is, without warranties.
1. About these terms
These Terms and conditions ("Terms") govern your use of the opencpr.org website, the request form, and the OpenCPR software, build guide and related materials (together, "OpenCPR"). OpenCPR is created and maintained by Light-it Inc. ("Light-it", "we", "us").
By using the website, submitting the request form, or downloading, installing or running OpenCPR, you agree to these Terms. If you accept them on behalf of an organization, you confirm that you have authority to bind that organization, and "you" refers to it.
2. What OpenCPR is
OpenCPR is open-source software that, together with hardware you provide (a CPR training manikin, a distance sensor, an Arduino board and a laptop or PC), creates a self-service hands-only CPR practice kiosk. The software guides compression rate and gives real-time feedback during practice.
3. Training tool, not medical care
- OpenCPR is an educational practice tool. It is not a medical device and is not intended to diagnose, treat or monitor any person or condition.
- It does not issue certifications and does not replace an accredited CPR or first aid course. People who need certification should take a course from an accredited provider.
- Feedback from the kiosk depends on the hardware, its calibration and how it is assembled. It may not reflect real-world performance.
- OpenCPR must only be used on training manikins. Never practice compressions on a person.
- In an emergency, call 911 or your local emergency number first.
4. The open-source license
The OpenCPR source code is licensed under the open-source license included in the code repository (the "License"). The License governs your rights to use, copy, modify and distribute the code. If anything in these Terms conflicts with the License as it applies to the code, the License prevails.
The build guide, documentation and website content are provided for you to build and run OpenCPR kiosks. You may share them with people helping you deploy a kiosk.
5. Requesting the code
We ask organizations to request the code through a form so we can send the right package, support first deployments and understand where OpenCPR is used. When you submit the form:
- You agree to provide accurate information about yourself and your organization.
- We may contact you by email about your request, your deployment and important updates to OpenCPR.
- We review requests and may decline or follow up on requests that appear inaccurate, abusive or outside the purpose of OpenCPR.
6. Your responsibilities as a deployer
If you build or run an OpenCPR kiosk, you are responsible for:
- Hardware. Sourcing, assembling and maintaining the manikin, sensor, Arduino, screen and any enclosure, following the manufacturers' instructions and safety guidance.
- Safe installation. Placing the kiosk where it is stable, accessible and does not create trip, electrical or other hazards, in line with local codes and your site's rules.
- Hygiene. Cleaning the manikin and touch surfaces between uses according to the manikin manufacturer's guidance.
- Supervision and signage. Deciding whether supervision is needed, especially where children use the kiosk, and displaying clear notices that the kiosk is a practice tool and that people should call emergency services in a real emergency.
- Visitor data. Any personal data the kiosk collects at your site, such as email addresses used to send results. You act as the controller of that data. See section 7.
- Compliance. Following the laws and policies that apply to your organization, your site and your visitors.
7. Data collected by your kiosk
OpenCPR is self-hosted. When you deploy it, the kiosk runs on infrastructure you control. Session results and any email addresses visitors enter are processed by your installation, not sent to Light-it, unless you choose to configure it otherwise.
As the operator, you are responsible for telling visitors what you collect and why, obtaining any consent required (including parental consent where children may use the kiosk), securing the data and deleting it when it is no longer needed.
8. Support and updates
We aim to help organizations with their first deployment by email. Support is offered in good faith, on a best-effort basis, and may change or end at any time. We may release updates to the code and guide, and are not obliged to maintain any particular version.
9. Name and logo
The OpenCPR name and logo, and the Light-it name and logo, belong to Light-it and are not licensed under the open-source License. You may say your kiosk is "powered by OpenCPR". You may not use the names or logos in a way that suggests Light-it endorses, certifies or operates your kiosk or organization, or that a modified version is the official OpenCPR, without our written permission.
10. Third-party content and links
The website links to third-party sites, such as grant programs and CPR organizations, and OpenCPR may rely on third-party hardware and open-source components. We do not control them and are not responsible for their content, availability, terms or practices. Grant information is provided for convenience and may change; check eligibility and deadlines with each funder.
11. Acceptable use
You agree not to use the website or OpenCPR to break the law, misrepresent OpenCPR as a certification or medical service, interfere with the website's security or operation, or submit false or automated requests through the form.
12. No warranties
OPENCPR, THE WEBSITE, THE BUILD GUIDE AND ANY SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OPENCPR WILL BE ERROR-FREE, THAT ITS FEEDBACK WILL BE ACCURATE, OR THAT USING IT WILL RESULT IN ANY PARTICULAR LEVEL OF CPR SKILL.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIGHT-IT AND ITS AFFILIATES, EMPLOYEES AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA OR LOSS OF PROFITS, ARISING FROM OR RELATED TO YOUR USE OF OPENCPR, THE HARDWARE YOU USE WITH IT, OR THE WEBSITE. BECAUSE OPENCPR IS PROVIDED FREE OF CHARGE, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnity
You agree to defend and indemnify Light-it against claims, damages and costs (including reasonable legal fees) arising from your deployment or operation of an OpenCPR kiosk, the hardware you use, the data your kiosk collects, or your breach of these Terms.
15. Changes and termination
We may update these Terms. When we do, we will change the "Last updated" date above, and material changes will apply going forward. We may stop offering the website, the form or support at any time. Your rights under the open-source License to code you have already received continue as the License provides.
16. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Miami-Dade County, Florida, unless the law where you live requires otherwise.
